What is Mutation of land ?
It is all about updating the land records. Mutation is nothing,but change in Record of Rights (RoR) i.e. changing entry in the Patta(textual RoR) and map.In Odia, mutation is called as Dakhal Kharaj. Updation of land records is a continuous process.It may arise due to sell/purchase of land, death of the recorded tenants, order of the civil court, relinquishment of rights, gift, transfer of rights through Will, etc. Mutation is a fiscal arrangement to collect land revenue.It does neither create nor extinguish any right, title and interest.Only civil court is competent to declare right, title and interest over any land.
With the passage of time,there is need to reflect the changes in the record of rights to keep it up-to-date. Rule 34 of Orissa Survey and Settlement Rules,1962 governs mutation.A bunch of executive instructions known as the Mutation Manual also delineate the procedure to be followed for mutation.
Competent Authority for Mutation:
The Tahasildar is the competent authority to initiate mutation.The Tahasildar includes the Additional Tahasildar.Grounds for initiation of Mutation:
The Tahasildar can initiate mutation proceeding :-(a) on receipt of intimation from the Sub-registrar or
(b)on receipt of intimation from any court or
(c) on receipt of intimation of acquisition of land under the land acquisition act or
(d) on an application filed by any person interested or
(e) on receipt of report from his sub-ordinates or
(f) on his own motion.
