1. Revision Petition for Pre-Settlement Cases
Many times a peculiar nature of cases comes to notice. Many people complain that they had purchased land but have not gotten the Patta despite the repeated approach to the Tahasildars.On close scrutiny, it is found that those documents were executed before the finalization of the Settlement Operation. We know that settlement operation in the state of odisha was conducted mostly during the 1980s. At that time many people could not produce their registered sale deed or other such documents before the settlement authority due to various reasons. Resultantly, they did not get the RoR of the land that they purchased/transacted before the settlement operation. When they visit the Bhulekh portal, it shows that the land is recorded in the name of the old recorded tenants or in the name of somebody else. The khata number and plot number mentioned in Bhulekh portal do not match with that mentioned in the registered sale deed. Such types of cases cannot be sorted out by the tahsildar as he has no power to entertain such documents which were executed before the date of final publication of RoR.The power lies with the Board of Revenue Odisha Cuttack which is the competent authority to take up such cases under section 15(b) of the Odisha Survey and Settlement Act,1958. So the people who are facing such problems can approach the revisional authority, i.e. Board of Revenue,Odisha, Cuttack by filing a revision petition. Considering the workload and distance of Cuttack from different parts of the state, the power of the Board of Revenue has been delegated to some other officers like the Revenue Divisional Commissioners, additional commissioners, Joint commissioners, etc so that the people are not subjected to unnecessary expenses and embarrassment. On filing such revision petitions, the competent court will initiate revision cases and call for reports from the settlement authority and the tahsildars. He will hear the parties concerned, peruse the reports, and pass necessary orders. Such a decision will be communicated to the tahsildar who will carry out the order and get the Record of Rights corrected. Then it will be provided to the petitioners. The basic concept involved in this case is the date of final publication of RoR which is vital to decide whether a revision petition is to be filed or not. So let us discuss how to know as to whether a registered sale dead is pre-settlement in nature or not. To know this, we have to check the date on which the sale deed was registered. Then we have to cross-check it with the date of final publication of RoR in that particular village. The date of final publication of the RoR by the settlement authority has been mentioned at the left bottom corner of the RoR or Patta. In Odia, it is written as ଅନ୍ତିମ ପ୍ରକାଶନ ତାରିଖ . If the date of registration is later than the date of final publication, then such cases do not necessitate any filing of a revision petition. On the other hand, if the date of registration is before the date of final publication of RoR , then filing of revision petition is necessary.
2. How to file a Revision case online?
The government has developed an
online portal for filing of Revision cases. It can be accessed by visiting the Board of Revenue website at https://boardodisha.nic.in.When you visit the website,you will come across a Link "Automation of Court" at the middle right side of the page.On clicking the link, It will redirect you to another page which is "Court Case Monitoring System."You have to register yourself as per the procedure given therein to file a case.There is a tab on the website which provides the step by step guidance for new registration. After the registration,the system will provide you the login ID and password to access the website.Using the same, a petitioner can file a revision petition online.
